These Terms of Service ("Terms") govern your use of SmartHal's website design and development services ("Services"), operated from Gwalior, Madhya Pradesh, India. By placing an order or making a payment, you agree to these Terms.
SmartHal offers website design, landing pages, e-commerce store setup, website redesign, custom development, and related digital services, as described on our website. Exact deliverables depend on the specific plan purchased.
All prices are listed in Indian Rupees (₹) and are as displayed on our website at the time of order. Full payment is required upfront via Razorpay before work begins, unless otherwise agreed in writing. Prices for custom or bulk/agency work are quoted individually and confirmed before payment.
Standard delivery timelines (such as 48 hours) apply to template-based plans once full payment and all required business details (content, photos, business information) have been received. Delays in providing these details will extend the delivery timeline accordingly. Custom development and bulk/agency projects follow timelines agreed upon individually.
You are responsible for providing accurate business information, content, and images required to build your website. You confirm that any content, logos, or images you provide do not infringe on the rights of any third party. SmartHal is not responsible for content or claims made on your website that you have provided.
Once full payment is received and the website is delivered, ownership of the final website design and content transfers to you, except for any pre-built templates, frameworks, or third-party tools used, which remain the property of their respective owners. SmartHal may showcase completed projects in its own portfolio unless you request otherwise in writing.
If you wish to cancel before work has begun, a full refund will be issued. If you are genuinely not satisfied with the delivered website, please contact us on WhatsApp within a reasonable time of delivery to discuss a resolution or refund, in line with our satisfaction guarantee. Refunds are not available for custom development or bulk/agency work once work has commenced, unless otherwise agreed.
Plans that include free hosting provide hosting through SmartHal's infrastructure for as long as the applicable maintenance/renewal terms are met. For plans where you provide your own domain or hosting, you are responsible for maintaining that domain/hosting and providing SmartHal with necessary access.
Primary communication for order details, updates, and support takes place over WhatsApp at the number listed on our website. It is your responsibility to respond promptly to requests for information needed to complete your project.
SmartHal is not liable for any indirect, incidental, or consequential damages arising from the use of our Services, including but not limited to loss of business, revenue, or data. Our total liability for any claim shall not exceed the amount paid for the relevant service.
We may update these Terms from time to time. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of the courts in Gwalior, Madhya Pradesh.
